TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 8, 2006, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Document No. 232783, in Book No. 1516, at Page 642, David Hiram Walker and Lisa L Walker did convey unto Richard A. Pill, Esq, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 11, 2011 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse in Morgantown, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Morgan District, Monongalia County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of real estate lying and being situate in Morgan District, Monongalia County, West Virginia, and being more particularly bounded and described as follows, to-wit:

BEGINNING at a 3/4" reinforcing rod (found) standing on the western right of way limits of West Virginia Secondary Route 70/4 and standing as the southeast corner to Parcel No. 2 of the McMillen Tract, as shown on a plat of said subdivision, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book No. 818, at Page No. 569, as conveyed to William D. and Carolyn S. Williams by deed recorded in the aforesaid County Clerk’s Office in Deed Book No. 1049, at Page No. 9; thence with two (2) lines with said limits of Route 70/4, S. 17°00′ 00" W. 110.00 feet to a point, said point stands on the cover of a water meter, said point stands as a common corner to Parcel No. 3 of the McMillen Tract (plat reference in Deed Book No. 818, at Page No. 569) and Parcel No. 1 of the McMillen Tract (plat reference in Deed Book No. 932, at Page No. 41); thence S. 18°09’00" W. 94.55 feet to a ½" reinforcing rod (found), and said rod stands as the northeast corner to Parcel No. 2 of the McMillen Tract, as shown on the plat of said subdivision recorded in Deed Book No. 932, at Page No. 41, as conveyed to Larry Cyrus by deed recorded in Deed Book No. 1030. at Page No. 326; thence with said Parcel No. 2 (932/41) and said Larry Cyrus parcel, N. 74° 30′ 00" W. 198.00 feet to a ½" reinforcing rod (set), said rod stands in the eastern line of a parcel conveyed to William D. and Carolyn S. Williams by deed recorded in Deed Book No. 1037, at Page No. 56; thence with said Williams parcel (1037/569) and the eastern limits of a 16 foot right of way, N. 18° 09’00" E. 94.55 feet to a ½" reinforcing rod (set); thence continuing with said limits of the 16 foot right of way, N. 17° 00′ 00" E. 110.00 feet to a ½" reinforcing rod (set), said rod stands as the southwest corner to Parcel No. 2 (818/569) and said Williams parcel (1049/9); thence with said Parcel No. 2 (818/569) and said Williams parcel (1049/9), S. 74° 30′ 00" E. 198.00 feet to the place of beginning, containing 40.473 square feet or 0.9291 acres, more or less, as shown on a plat prepared by Allan J. Witschi, PS. No. 587, dated January 10, 1994, which is recorded in said Clerk’s Office. Said plat is referred to for all pertinent purposes and is made a part of this description.

Being all the same lands conveyed to Darrell C. Belcher and David H. Walker, Jr. By Patrick A. Mead and Kami L. Mead by deed dated the 20th day of June, 2000, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1200, at Page 200.

This conveyance is made subject to any and all existing reservations, restrictions, rights-of-way and conditions as are contained in the chain of title to said property.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 938 Breakiron Hill Ridge, Morgantown, WV 26508.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
