NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated November 10, 2011, executed by the Borrowers, Kevin L. Cramer and Courtney B. Cramer, to L. Richard Dorsey, the Trustee, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 1839, at Page 633. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1195 Lehigh Dr., Morgantown, WV 26508. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated September 23, 2016, of record in the Clerk’s Office in Book 2147, at Page 636. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on the following date:

November 9, 2016 at 1:18 p.m.

All of the following described lot or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate, lying and being in Morgan District, Monongalia County, West Virginia, being known as Lot No. 92 Westbrook Heights Addition, which is more particularly described as follows:

Beginning at an iron pin on the western right of way line of Lehigh Drive, a forty (40) foot street, at a corner to Lot 93; thence with said right of way line, S. 13 degrees 56′ 50" E. 100.00′ to an iron pin corner to Lot 91; thence S. 76 degrees 03′ 10" W. 100.00′ to an iron pin on line of Lot 103; thence with Lots 103 and 102, N. 13 degrees 56′ 50" N. (sic W.) 100.00 feet to an iron pin corner to Lot 93; thence with Lot 93, N. 76 degrees 03′ 10" E. 100.00 feet to the point of beginning, containing 10,000 square feet (0.2296 acre), more or less.

Together with the right to use Lehigh Drive and the other roads in Westbrook Heights for the purpose of connecting to, installing, servicing and repairing telephone, electric, gas, water, sewer and television cable lines and pipelines and for vehicular and pedestrian ingress, egress and regress, to the extent acquired by Grantors in the deed aforesaid.

Subject to the Protective Covenants, Restrictions and By Laws Pertaining to Westbrook Heights Addition and Westbrook Heights Homeowners Association, a copy of which said Protective Covenants and Restrictions is recorded in the Monongalia County Clerk’s Office at Deed Book No. 930, page 256, and the Corporate Charter of said Homeowner’s Association is recorded in said Clerk’s Office in Corporation Book No. 41, at page 19, together with any and all amendments thereto.

Being the same real estate conveyed unto Kevin Cramer and Courtney Cramer from Jamie H. Ealy, As Trustee, or his Successors in Trust, Under that Certain Trust Established Under the Last Will and Testament of Howard C. Ealy, Deceased, by deed dated November 7, 2011, and to be recorded herewith in the Office of the Clerk of the County Commission of Monongalia County, West Virginia.

And further being the same property conveyed to Kevin Cramer by the Quitclaim Deed dated October 9, 2013 and recorded in Deed Book 1486, at Page 257, in the Office of the Clerk of the County Commission of Monongalia County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
