TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 13, 2010, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed of Trust Book 1748, at page 466 and rerecorded in Deed of Trust Book 1948, at Page 615, Michael W. Pyles and Savannah S. Pyles did convey unto Michael L. Solomon and Susan L. Petrella, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse, in Morgantown, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Morgan District, Monongalia County, West Virginia, and more particularly described as follows:
PARCEL l – All of the following described real estate, with the improvements thereon, situate, lying and being in the Morgan District, Monongalia County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a stone corner of line of Gay Dalton on bank of Sarver Road and running in a southeasterly direction with said road 400 feet to a stone corner in line of lands belonging to the aforesaid Brooks McDonald; thence with said line 300 feet to a stone corner at junction of said line with lands of Gay Dalton; thence with said Gay Dalton’s land 360 feet to the beginning, containing approximately one and one-third acres (1-1/3 ac.).

There is EXCEPTED all coal, oil, gas and other minerals underlying the above-described property.

There is EXCEPTED that portion of the above-described parcel as was conveyed by Delbert F. McDonald and Marlene McDonald to Samuel Gillum and Karen Gillum by deed dated June 29, 1976, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 777 at page 629, which consists of approximately 15.8 feet along the eastern boundary of the above described 1.33 acre parcel.

PARCEL 2 – All of the following described real estate, with the improvements thereon, situate, lying and being in the Morgan District, Monongalia County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a point on the southern side of the Sarver Road, 300 feet from the corner of Gay Dalton, and continuing with the line of said Sarver Road for a distance of 100 feet to lands of Brooks McDonald; thence leaving said road with the line of Brooks McDonald a distance of 150 feet, thence by a line parallel with the Sarver Road, in a northwesterly direction, a distance of 100 feet; thence at right angles thereto and parallel with the line of Brooks McDonald, a distance of 150 feet to the place of beginning, and being a part of that certain tract of 1-1/3acres as conveyed to Delbert McDonald and Marlene McDonald by deed from Brooks McDonald and wife, dated October 1, 1960, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book No. 644 at page 367.

There is EXCEPTED that certain parcel of real estate conveyed to Samuel Gillum and Karen Gillum by deed dated July 14, 2006, and recorded in the aforesaid Clerk’s Office in Deed Book 1322 at page 1.

This conveyance is made subject to all exceptions, reservations, restrictions, conditions, easements and rights of way as contained in prior deeds of record for this chain of title.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 18 Delbert Lane, Morgantown, WV 26508.

AND BEING the same real estate which was conveyed to Michael W. Pyles and Savannah S. Pyles by Deed dated May 12, 2010, from Richard McDonald, Pamela Wilson, David McDonald, Kristina Bennett, and Brenda Brooks, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1412, at Page 852.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
