TRUSTEE’ S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 28, 2004, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Document No. 157607, in Book No. 1274, at Page 444, Carla J. See did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 5, 2009, and recorded in the aforesaid Clerk’ s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A., to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse in Morgantown, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Fourth Ward District, Monongalia County, West Virginia, and more particularly described as follows:

ALL of that certain lot or parcel of real estate, together with the buildings thereon and appurtenances thereunto belonging, situate, lying and being in the Fourth Ward of the City of Morgantown, Monongalia County, West Virginia, and more particularly bounded and described as follows, to-wit:

282 Richland Avenue

BEGINNING at a ½’ iron pin on the Northern edge of Richland Avenue, corner to Vickie Gashie; thence leaving Richland Avenue and with line of Gashie, N. 26°08′ E. 117.23 feet to a ½" iron pin on the Southern edge of a 12 foot alley, corner to said Gashie; thence with two lines of said alley, S. 66°49′ 51" E. 41.67 feet to a ½" iron pin; thence S. 60° 23′ 51" E. 33.45 feet to a ½" iron pin, corner to Frances Twigg; thence leaving said alley and with line of said Twigg, S. 26°08′ W. 117.36 feet to a ¾" iron pipe on the Northern edge of Richland Avenue; thence with line of Richland Avenue, N. 63° 52′ W. 75.00 feet to the place of beginning, and being all of Lot 47, the Eastern 32.8 feet of Lot No. 46 and the Western 2.2 feet of Lot No. 48, as the same fronts on Richland Avenue, of the County Club Park Realty Addition to the said Fourth Ward of the City of Morgantown, a map or plat of said Addition being of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 167, at Page 268 ½, and as shown upon plat of survey prepared by Carl Morris, LLS No. 460, of McCoy Land Surveying Inc., dated August 1988, and attached to a deed of record in Deed Book 981, at Page 398.

BEING the same real estate conveyed to Carla J. See, by deed from Lee B. Smith, dated the 16th day of September, 2002, and recorded in the aforesaid County Clerk’s Office in Deed Book 1239, at Page 640.

Subject to all reservations, agreements, exceptions, land use regulations, covenants, municipal ordinances, conditions, rights of way, restrictions, prior out conveyances, casements, mineral severances, and limitation of use as may appear of record.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 282 Richland Avenue, Morgantown, WV 26505.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’ s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
