NOTICE OF SALE UNDER DEED OF TRUST Under authority of certain Deeds of Trust and an Amended Deed of Trust from JoAnn Cooper DBA K-B Kids, all dated the 6th day of July, 2007, to A. David Abrams, Jr., Trustee, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in chronological order in Book 5027, at Page 6367 and in Book 5036 at Page 4840 and in Book 5037 at Page 0046 ; default having been made in the payment of the obligations secured by said Deeds of Trust and Amended Deed of Trust and sale having been requested in writing by the holder of the obligation secured; the undersigned will offer for sale at the front door of the Courthouse of Raleigh County, Beckley, West Virginia, at 10:00 a.m. on Friday, May 6, 2016, that certain real estate conveyed by said Deed of Trust as described on the Exhibit A attached hereto and made a part hereof. EXHIBIT A And being that certain real estate located in Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows: Beginning at a point on the eastern right-of-way line of US Route 19, being a common corner to John and Sandra Pack; thence, with the Pack property N 43 f 34′ 00″ E for 185.00 feet to a point, passing an axle (found at 6.86 feet, said point being S 02 f 07′ 24″ E and 0.24 feet from an 3/4″ rebar (found) and S 43 f 34′ 00″ W and 42.13 feet from a 3/4″ rebar (found), said point being a common corner to Josephine Price and on the line of John and Sandra Pack; thence, with the Price property S 46 f 26′ 00″ E for 90.14 feet to a 5/8″ rebar and cap (set), being on the line of Josephine Price; thence, with the new division lines through the parent tract for the following two courses and distances: S 51 f 55′ 02″ W for 127.60 feet to a chain link fence post; thence, S 51 f 48′ 52″ W for 64.20 feet to a 5/8″ rebar and cap (set) being on the eastern right-of- way of US Route 19; thence, With said right-of-way line for the following two course and distances: N 42 f 40′ 00″ W for 15.89 feet to a point; thence, N 41 f 49′ 51″ W for 46.69 feet to the point of beginning and containing 14,323 square feet or 0.329 acres, more or less. And being part of the same property heretofore conveyed to The Watchful Eyes Day Care Center, Inc., a corporation, by Deed dated May 8, 1987 from Roger D. Bragg and Jo Ellen Bragg, husband and wife, which Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 721, at page 512. There is hereby also granted and conveyed to the trustee(s) all right, title and interest of the grantor in and to that certain easement for use of the septic system on the adjoining property as well as that certain easement granting the right to install a sewer line through the property of the predecessor in title to the grantor. This Deed of Trust is made and accepted subject to all prior reservations, restrictions, covenants, and conditions granted or reserved by all predecessors in title except those pertaining to race, color or creed. And being the same property heretofore acquired by JoAnn Cooper doing business as K-B Kids, by Deed dated the 6th day of July, 2007, from The Watchful Eyes Day Care Center, Inc., a corporation and which Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5027, at page 6365. The above described real estate will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and made subject to all property taxes, prior liens, including any liens for sewer service assessed by any municipality or public service district, reservations, encumbrances, restrictions, right of way, easements, covenants, conveyances and conditions of record in said Clerk’s Office and affecting the subject property. The subject property will be sold in AS IS condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS OF SALE Cash in hand on day of sale. The above-described real estate will be sold by the undersigned by auction to the highest bidder subject to the right of the undersigned to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have the right to bid. CONTINUANCE – ADJOURNMENT OF SALE The undersigned reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice than announcement of the time and the place of sale as hereinabove set forth for any continuance or adjournment thereof.
