NOTICE OF SUBSTITUTE TRUSTEE SALE

 

WHEREAS, By virtue of a trust deed dated November 4, 2005, made by Edward T. Wasmer, III, to David F. Booth or Elta K. Cottrell, Trustees, of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Lien Book 1325, Page 727, said Trustees were empowered to sell the hereinafter described real estate pursuant to the terms and conditions set out in said deed of trust; and

WHEREAS, the said Substitute Trustee having been substituted by an Appointment of Substitute Trustee, dated April 23, 2015, recorded May 5, 2015, of record in Lien Book 1868, page 88, executed by Michael L. Allen, ExVP and Traders Division President, on behalf of said bank and the undersigned trustee, Kimberly A. Wright, having been appointed as Substitute Trustee thereunder by said Appointment of Substitute Trustee, and the grantors of the deed of trust having defaulted in the payment of a note secured thereby and the undersigned Trustee having been directed by the holder of the note to sell the real estate securing said note, I will sell at public auction on June 15, 2015, commencing at 11:30 A.M. at the front door of the Courthouse situate in the City of Parkersburg, Wood County, West Virginia, the following described real estate, to-wit:

 

All those certain lots, tracts or parcels of real estate, situate, lying and being in Williams District, Wood County, West Virginia, more particularly bounded and described as follows:

 

PARCEL ONE: Rental House and Two Lots

 

FIRST TRACT:

 

That certain 0.304 acre tract as more particularly described on a survey plat prepared by Paul K. Marshall dated February 8, 1999 and revised on March 21, 1999, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 1003, at page 234.

 

SECOND TRACT:

 

Beginning in a easterly line of Moats street, said point being N. 36 deg. 53á 50ã E. 88.23 feet from the northerly line of 46th Street; thence with the easterly line of Moats Street, N. 36 deg. 53á 50ã E. 110 feet thence leaving Moats Street, S. 51 deg. 45á 01ã E. 98.51 feet; thence S. 36 deg. 37á 50ã W. 116 feet; thence N. 48 deg. 17á 52ã W. 99.37 feet to the place of beginning containing 11,158 square feet and being designated as Lot #2 on that certain survey plat prepared by Paul K. Marshall.

Beginning in the easterly line of Moats Street said point being N. 36 deg. 53á 50ã E. 198.23 feet from the northerly line of 46th Street; thence with the easterly line of Moats Street, N. 36 deg. 53á 50õ E. 95 feet; thence leaving Moats Street, S. 62 deg. 11á 22ã E. 99.2 feet; thence S. 36 deg. 37á 50ã W. 113 feet; thence N. 51 deg. 45á 01ã W. 98.51 feet to the place of beginning, containing 10,217 square feet and being designated as Lot 43 on that certain survey plat prepared by Paul K. Marshall.

 

The real estate designated herein as Parcel One, is the same real estate as conveyed unto Edward T. Wasmer, III and Cindy M. Forshey, unmarried by deed dated November 3, 1999, of record in the aforesaid Clerkás Office in Deed Book 1006, page 384.

Thereafter, by deed dated November 4, 2005, of record in Deed Book 1089, page 664, Cindy M. Minigh, formerly known as Cindy M. Forshey, conveyed her undivided right, title and interest in and to the aforesaid real estate unto Edward T. Wasmer, III.

Thereafter, by deed dated November 8, 2005, recorded October 1, 2014, of record in Deed Book 1220, page 390, Cindy M. Minigh, formerly known as Cindy M. Forshey, conveyed her undivided right, title and interest in and to the aforesaid real estate unto Edward T. Wasmer, III.

Being all that certain 0.368 acre tract identified as Tract E as both described and shown on that certain survey plat dated March 21, 1999, Revised, prepared by

The real estate designated herein as Parcel Three, Parcel One, is the same real estate as conveyed unto Edward T. Wasmer, III by Eugene W. Moats and Annette C. Moats, his wife, by deed dated June 3, 1999, of record in the aforesaid Clerkás Office in Deed Book 1003, page 238.

Being all that certain 0.271 acre tract identified as Tract D. as both described and shown on that certain survey plat dated March 21, 1999, revised, prepared by Paul K. The real estate designated herein as Parcel Three, Four and Five, is the same real estate as conveyed unto Edward T. Wasmer, III, also known as Pete Wasmer by Eugene W. Moats and Annette C. Moats, his wife, by Correction Deed dated June 3, 1999, of record in the aforesaid Clerkás Office in Deed Book 1003, page 231.

There will further be granted and conveyed that certain nonexclusive use of that certain 20 foot wide right of way for purposes of ingress and egress from 46th Street to Moats Street as shown on the above referenced survey plat recorded in Deed Book 1003, page 239, including the shaded area thereof.

 

This sale is made subject to all oil, gas and other mineral reservations and sales as made by predecessors in the chain of title and to all valid existing rights of way and easement appearing of record.

This sale is made subject to all unpaid real estate taxes.

The undersigned Trustee reserved the right to adjourn the sale from time to time by oral proclamation or other announcement at the aforesaid place of sale.
