CRITICAL NEEDS PROJECT FOR BLUEBIRD LANE
General Notice
Lubeck Public Service District (Owner) is requesting Bids for the construction of the following Project:
Critical Needs Project For Bluebird Lane
T20-11129
Bids for the construction of the Project will be received at the Lubeck Public Service District located at 301 Ox Johnson Lane, Washington, WV 26181, until Thursday, January 18, 2024 at 2:00 pm local time. At that time the Bids received will be publicly opened and read.
The Project includes the following Work:
Removal and Replacement of approximately 150 LF of 24″ Corrugated Metal Culvert Pipe with New 24″ HDPE Corrugated Plastic Pipe, Removal and Replacement of approximately of 130 LF of 8″ Gravity Sewer with New 8″ Gravity Sewer, three (3) New 48″ Sanitary Sewer Manholes, one (1) New 24″ Drop Inlet, one (1) New Concrete Wingwall, with various related restorations and requisite appurtenances.
Bids are requested for the following Contract: Critical Needs Project For Bluebird Lane
The Work will be substantially completed within 30 calendar days after the date when the Contract Times commence to run, and completed and ready for final payment within 60 days after the date when the Contract Times commence to run. Liquidated damages shall be $500 per day.

Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.

Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8:00 am to 5:00 pm and may obtain copies of the Bidding Documents from the Issuing Office as described below. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office.
Printed copies of the Bidding Documents may be obtained from the Issuing Office by paying the amount of each set listed below.
Bidding Documents may be purchased from the Issuing Office during the hours indicated above. Cost does not include shipping charges. Upon Issuing Office’s receipt of payment, printed Bidding Documents or electronic documents will be transmitted to the prospective Bidder. The shipping charge amount will depend on the shipping method requested. Bidding Documents are available for purchase in the following formats:

A two envelope system will be used.

Envelope No. 1 must have the following information presented on the front:

Name and address of Bidder
Bid on Contract – Critical Needs Project For Bluebird Lane
Received by the Lubeck Public Service District

Envelope No. 2 labeled “Bid Proposal” shall also be placed inside of Envelope #1.

Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR – 1 of these contract documents. If such documents are found to be in order, Envelope No. 2 “Bid Proposal”, will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 “Bid Proposal” will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder.

A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids.

Bids shall be accompanied by a certified check or bid bond payable to Lubeck Public Service District in an amount equal to five percent (5%) of the base bid.

Suspension and Debarment – Recipient shall not entertain the use of businesses that are listed on the “System for Award Management” (SAM) at www.Sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

Drug Free Workplace – West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed drug-free workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provisions of Article 1D, Chapter 21 of the West Virginia code. Failure to submit the signed drug-free workplace affidavit in the first envelope shall result in disqualification of such bid.

DBE Requirements – Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents.

The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.

All Bidders are required to have a West Virginia Contractor’s License per Section ยง30-42-12 of the West Virginia Code.

Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders.
The Lubeck Public Service District reserves the right to reject any and all bids.

Pre-bid Conference
A pre-bid conference for the Project will be held on Thursday, January 4, 2024 at 10:00 am at Lubeck Public Service District, 301 Ox Johnson Lane, Washington, WV 26181. Attendance at the pre-bid conference is encouraged but not required.
