NOTICE OF TRUSTEE SALE
Pursuant to the authority vested in the undersigned Thomas R. Zimmerman, Trustee, a resident of Monongalia County, West Virginia, by Deed of Trust dated June 14, 2022, made and executed by Robert C. Morehardt to Gavin C. Ward, Trustee, which Deed of Trust is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Trust Deed Book 2248 at page 209. Whereas, the holder and owner of the indebtedness secured thereby having substituted the trustee by instrument recorded on April 1st 2024 in the Office of the said Clerk of the County Commission in Book 2321 at page 736, the undersigned Trustee has been requested, in writing, by the beneficiary of said Deed of Trust to sell the real estate described below, as there has been a default under the terms and conditions of said Deed of Trust, and the note and indebtedness thereby secured. Therefore, the undersigned Trustee, will sell some or all of the real estate, as may be required, described in the Deed of Trust at public auction to the highest bidder at the front door of the Wood County Courthouse, situate 1 Court Square, Parkersburg, West Virginia (sale will be held on the front steps unless inclement weather requires sale to be conducted just inside the courthouse near the said front door) on:
Tuesday, April 30th 2024 at 9:00 A.M. EDT
All of that certain tract or parcel of land situate and being in the District of Union, County of Wood, State of West Virginia, bounded and described as follows:
Being all of Lots now Twenty-Nine (29), Thirty (30), Thirty-One (31), Thirty Two (32) and Thirty-Two-A (32A) as shown on a plat of Division of Lots now 29, 31, and 32 of Oakwood Estates, a plat of Oakwood Estates being of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Plat Book No. 14, at Page 41, which plat of the division of Lots No. 29, 31, and 32 of Oakwood Estates was prepared by Paul e. Marshall, County Surveyor and a copy of said plat, dated July 17, 1973 is attached to that deed of record in the aforesaid Clerk’s Office in Deed Book 620, at Page 236, to which reference is had and made a part hereof. Such conveyance contained in General Lien Book 2248 at Page 209 is subject to all the covenants, building restrictions, reservations and rights-of-way in the said Clerk’s Office including that deed to Jack E. Headley, et. Ux. and that deed of record in Deed Book 1257, at Page 279. Being the same property conveyed unto Robert C. Morehardt by deed of 260 Oak, LLC, dated April 24, 2021 of record in the said Clerk’s Office in Book 1323 at Page 133. TERMS OF SALE
1. Certified funds, cash or approved credit hand money in the amount of $5,000.00 on the day of sale and balance payable within 10 days.
2. Subject to any and all assessments and taxes and rights of government entities of every nature against said property and all prior liens and encumbrances of any nature whatsoever.
3. The purchaser shall be responsible for deed recording costs and for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code as well as document preparation costs necessary to close the sale transaction.
4. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of said described above or any adjournment thereof.
5. The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W.Va. Code ยง 38-1- 6. The Trustee makes no representation and warranties about the title of the real estate to be conveyed.
7. The purchaser will take the property subject to any deed of trust, judgment, lien, and any other encumbrance that is junior to this Deed of Trust and to which sufficient notice was not given.
8. The property is sold subject to an accurate survey at purchaser’s expense.
9. The purchaser may assign its rights prior to delivery of the trustee’s deed, provided that such assignment is in writing, notarized, and provides for assignee to be subject to all obligations of purchaser in the premises.
10. If the trustee is unable to convey insurable or marketable title, subject to the terms of this notice and sale, to purchaser for any reason, purchaser’s sole remedy is return of deposit.
