The West Virginia Department of Environmental Protection (WV DEP), Division of Water and Waste Management (DWWM) intends to issue a permit to Chemours Company LLC located in Washington, WV for the treatment, storage, and disposal of Listed wastes in Part (A). This permit will be issued under the authority of West Virginia Code, Chapter 22, Article 18. The facility has been assigned EPA identification number WVD045875291, and is in Washington, Wood County, West Virginia.

The State of West Virginia is authorized to administer and enforce a hazardous waste management program, in lieu of the federal program for portions of the Resource Conservation and Recovery Act of 1976 (RCRA), Amendments of 1984 (HWSA). HWSA imposes additional requirements on hazardous waste management facilities that will be enforced by the U.S. Environmental Protection Agency (EPA) until the State of West Virginia receives authorization for those requirements.

State Law (Article 18, Chapter 22 of the W.Va. Code) requires Chemours to have a permit for managing waste storage covered under the RCRA rules. The Hazardous Waste Management System also requires that West Virginia Department of Environmental Protection provide the public with an opportunity to participate in the permitting process (public notice and opportunity to request a hearing).

A copy of the administrative record, including the permit applicant’s application, draft permit, and fact sheet will be available for review at the Department of Environmental Protection’s Public Information Office, 601 57th Street, Charleston, W.Va. 25304, (304) 926-0499 ext. 43846.

During the designated 45-day public comment period, persons wanting to review any information should contact the Talal Fathallah at (304) 926-0499 ext. 43846 and (304) 552-3100 to schedule an appointment. Any person desiring site-specific or technical information should contact the facility contact person Mr. Jason Sanders at (304) 273-6978 also the same documents will be available for public review at WV DEP Office.

Permit conditions are tentative and open to public comment. Persons wishing to comment on the draft permit must submit their comments in writing to: Dawn Jones.

Relevant written comments received during this 45-day comment period, on or before 4:00 p.m. on August 30, 2020, will be considered in the final permitting decision. Persons desiring a public hearing should send their written request, stating the nature of the issue(s), to the West Virginia Department of Environmental Protection at the address noted above and during the comment/review period. If a public hearing is warranted, the director will provide the public with a notice of at least (30) days prior to the scheduled hearing. Following the comment period, the director will make the permitting decision.

If the terms and conditions of the permit remain substantially unchanged from those announced by this notice, the director will issue the permit and response to all persons who submitted written comments, plus any person who requested the response. If the terms and conditions are substantially changed, the director will offer the public an opportunity for review and comment on substantial changes before the final permitting decision.
