NOTICE OF SUDDENLINK SHOW CAUSE PROCEEDING

Suddenlink Communications offers cable television service to more than 300,000 households and small businesses in West Virginia. Since 2019, the Public Service Commission of West Virginia has received nearly 1,900 complaints from West Virginia subscribers regarding Suddenlink’s cable television service.

On July 1, 2021, the Public Service Commission opened a proceeding to require Suddenlink Communications to show cause as to why Suddenlink should not be required to take specific remedial steps and the Commission should not impose penalties as authorized by state law.

The Commission set a procedural schedule, including public comment hearings at 10:30 a.m. and 6 p.m. on Tuesday, August 24, 2021, and an evidentiary hearing to begin at 9:30 a.m. Thursday, August 26, 2021, in the Howard M. Cunningham Hearing Room at the Commission’s offices at 201 Brooks Street, Charleston, West Virginia.

Several municipalities and county commissions across the State have entered into franchise agreements with Suddenlink, and those separate franchise agreements may impose responsibilities or obligations on Suddenlink that are in addition to the statutory requirements of the Cable Television Systems Act, W. Va. Code ยง 24D-1-1 et seq. Franchising authorities may wish to provide information to the Commission about Suddenlink’s cable television service in their respective franchise areas or petition to intervene in this proceeding.

Anyone desiring to intervene and act as a party in this case should file a Petition to Intervene within ten days following the date of this publication, complying with the rules on intervention set forth in the Commission’s Rules of Practice and Procedure. The Commission will receive oral comments at the hearings in Charleston on August 24, 2021. Anyone desiring to file a written comment should do so as soon as possible although comments will be accepted throughout the pendency of this proceeding.
