TRUSTEE’ S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 21, 2011, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Document No. 404769, in Book No. 1803, at Page 469, Marisa L. Holland and Richard E. Holland did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 19, 2017, and recorded in the aforesaid Clerk’ s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse in Morgantown, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Union District, Monongalia County, West Virginia, and more particularly described as follows:

All of that certain lot or parcel of land known as Lot No. 12 of Block 300 of that certain subdivision known as Greystone-On-The Cheat, plats of which lot, block, and subdivision are recorded in the Office of the Clerk of the Monongalia County Commission in Map Cabinet No. 2 in Envelope Nos. 336-A and 336-B, to which said plats reference is here made for all relevant purpose.

And being further described as follows Beginning at a 1/2 inch rebar set on the northwestern right of way limits of a cul-de-sac off North Greystone Drive, 50.00 feet from the center, corner to Lot No. 11, thence leaving the said cul-de-sac limits and with Lot No. 11, North 71° 14′ 39" West 178.31 feet to a 1/2 inch rebar set on the southwestern line of Mary Belac Tract, corner to Lot No. 11, thence leaving Lot No. 11 an with the Mary Belac Tract, North 28° 44′ 37" East 262.32 feet to a 1/2 inch rebar found on the southern right of way limits of West Virginia County Route Numbered 88/2, corner to Mary Belac; thence leaving Mary Belac and with the said right of way limits of Route 88/2, South 80° 16′ 49" East 98.00 feet to a 1/2 inch rebar set on southern right of way limits of the said West Virginia Route and corner to Lot No. 13, thence leaving the said right of way limits and with Lot No. 13, South 07° 04′ 11" East 246.61 feet to a 1/2 inch rebar set on northern right of way limits of a cul-de-sac off North Greystone Drive, being a point on a curve to the right having a radius of 25.00 feet, thence leaving a Lot No. 13 and with said cul-de-sac right of way limits and curve, using the chord as the reference line (this call is correctly designated South 07° 04′ 11" West on the hereafter referenced plat) North 80° 08’42" West 14.57 feet to a point on the northern right of way limits of said cul-de-sac, 50.00 feet from the center, being the PRC (Point of Reverse Curvature) of a curve to the left, thence with said cul-de-sac right of way limits and curve, 50.00 feet from the center, using the chord as a reference line, South 67° 47′ 07" Wet 75.50 feet to the point of beginning, containing 1.06 acres, more or less, as surveyed during May through August 1986, by Laurel Mining Consultants, Inc, Kingwood, West Virginia, and certified as surveyed by Vincent W. Wood, LLS, No 664, and as shown on a plat which is recorded in the office of the Clerk of the Monongalia County Commission, in Map Cabinet No 2, Envelope No 336-A

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 3404 Fawn Lane, Morgantown, WV 26505.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’ s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
